- With the vast amount of research data published every day, it now became almost impossible for individuals or groups of scientists to consult them all. This is where text and data mining (TDM) comes it to play, by providing these people with tools to efficiently retrieve new information from already existing texts and data. From a legal point of view, the interplay between TDM and copyright has long been uncertain in the European Union, until only very recently with a directive from 2019. The evolution of the copyright framework in this regard is at the core of this thesis. What advances did some Member States make before the Directive? What was added by the Directive? How did the transposition work out? This thesis will provide answers to these questions.
