Abstract

In this paper, I’ll review the actual European merger guidelines in play concerning mergers and acquisitions. From there, I’ll analyse their reach and the tools linked to them in an effort to define whether such rules are still relevant in an ever growing digital and technological world. The analysis will be transposed onto real life cases to highlight any of the criticism and flaws discovered previously. Finally, a discussion about possible remedies and personal opinions will be held to try to close the subject. This paper will be built around official rules, literature and public cases. The motivation is not to have a black or white type of answer, but rather to feed the debate concerning a very sensitive and present debate.
