Abstract
State immunity, a longstanding principle in international law, often comes into conflict with the imperative to address serious human rights violations. This work explores this tension, examining the recent legal practices. It traces briefly the historical roots of State immunity, analyzes the influence of jus cogens norms, and examines the significant impact of pivotal cases, especially the Germany v. Italy case of the ICJ. Through comparative case studies from jurisdictions such as Italy, South Korea, Brazil, and Ukraine, this work focuses on the evolving global debate over the potential for humanitarian exceptions to State immunity.
