- This thesis aims to assess whether the terrorism exceptions to state immunity established by the United States and the Canadian legislations align with international law. The study will begin with an overview of these legislations, including an explanation of the rationale behind their adoption. It will then address the research question by exploring various debates within the international community regarding the compatibility of these terrorism exceptions with international law. Finally, the thesis will determine whether a customary international law exception to state immunity for state sponsors of terrorism exists, based on state practice and opinio juris, and will draw comparisons with other established exceptions to state immunity.
