Abstract
The concept of vulnerability holds an important, yet often overlooked role. With a digital market governed by new technologies, vulnerability has become a source of exploitation and algorithmic discrimination. This study aims to determine how AI-based technologies exacerbate pre-existing vulnerabilities or create new ones, with the objective of establishing if European law grants protection to vulnerable consumers and to what extent. The core revolves around the negative impact that AI-deriving technologies can have on individuals. The analysis rests on the comparison between vulnerability under European consumer law and European Acts implementing digital decade. On this ground, this work proposes a newer and wider perspective centred on vulnerability and addresses potential solutions to tackle legal gaps within this framework.
