- The standardization process has given rise to lots of litigations in the past decade. Its appraisal under EU Competition Law is constantly evolving. This thesis aims to give an analysis of the issues that arise in that process and their interactions with Competition Law. We address the specific issues of standardization agreements under article 101 TFEU. We also develop the issues of hold-up, patent ambush, royalty stacking, reverse hold-up, non-practicing entities (including patent trolls) and over-declaration under article 102 TFEU. A comparison with US Law is also made before a presentation of the evolutions and prospects of the matter. We finally assess whether the current EU Competition Law framework is able to tackle those issues.
