- Abstract
- The master thesis examines the obligation to extradite or prosecute as well as other obligations considered to be a part of the aut dedere aut judicare principle as “a system” in the recently adopted Ljubljana – The Hague Convention on International Cooperation in the Investigation and Prosecution of the Crime of Genocide, Crimes against Humanity, War Crimes and other International Crimes (Ljubljana – The Hague Convention) and compares them to the relevant provisions of the preexisting conventional regime dealing with the suppression of the crimes under the scope of the Ljubljana – The Hague Convention, namely, war crimes, the crime of genocide, crimes against humanity, the crime of torture, the crime of enforced disappearance, and the crime of aggression. The main objective is to explore whether the gaps in the conventional regime regulating the aut dedere aut judicare obligation concerning these particular international crimes could be potentially filled by the Ljubljana – The Hague Convention.
